DMCA Policy

White Bean Pasta respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998, the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, White Bean Pasta will respond expeditiously to claims of copyright infringement committed using the White Bean Pasta service and/or website (the "Site") if such claims are reported to White Bean Pasta's Designated Copyright Agent identified below.

Filing a Notice of Copyright Infringement

If you are a copyright owner, or are authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the White Bean Pasta service, please submit a written DMCA Notice to our Copyright Agent. Your notice must include substantially the following information:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
  2. A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit White Bean Pasta to locate the material (e.g., the URL(s) of the infringing material).
  4. Your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Upon receipt of a valid DMCA notice, White Bean Pasta will remove or disable access to the infringing material and take reasonable steps to notify the user who posted the material that it has been removed or disabled.

Counter-Notification Procedures

If you believe that your material has been removed or disabled by mistake or misidentification, you may file a counter-notification with White Bean Pasta by submitting a written counter-notification to our Copyright Agent that includes substantially the following information:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which White Bean Pasta may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, White Bean Pasta will promptly provide the complaining party with a copy of the counter-notification. If the complaining party does not inform White Bean Pasta that they have filed an action seeking a court order to restrain the user from engaging in infringing activity within 10 business days of receiving the counter-notification, White Bean Pasta may restore the removed material or cease disabling access to it.
